In California, retaliation is its own, separate claim, based on another underlying claim. Even if the organization prevails on the underlying claim, the employee can still prevail on the retaliation claim. That’s why it’s so important to train managers and supervisors about retaliation and to avoid actions that could result in a finding of retaliation.
