California Court of Appeal Districts

California has six Court of Appeal districts. Michael Trust Law, APC is headquartered in Hermosa Beach, California, which is within the Second Appellate District, and the firm represents clients throughout California across all six districts. The appellate district that hears any given case is generally determined by where the underlying employment dispute arose. Because different appellate districts can reach different conclusions on the same legal issue, and because those conflicting decisions stand until and unless the California Supreme Court resolves the disagreement, the outcome on a similar issue can vary depending on which appellate district hears the case. Decisions from districts outside the Second Appellate District are not binding on courts within the Second District but can be persuasive. Under Auto Equity Sales, Inc. v. Superior Court (1962) 57 Cal.2d 450, a California trial court is bound by every published California Court of Appeal decision. When the trial court’s own appellate district has not ruled on a particular issue, the trial court must follow any published Court of Appeal decision from another district. When Courts of Appeal in different districts have ruled and reached conflicting conclusions on the same issue, the trial court has discretion to choose which decision to follow. As a result, where a case is heard — and which district’s law has developed on a given issue — can materially affect the outcome until the California Supreme Court resolves any conflict.

PAGA Representative Claims
